Lawful Interception, Constitutional Limits: Surveillance and Service Suspension under the Telecommunications Act, 2023

Abstract

The Telecommunications Act, 2023, replaced a colonial-era framework, principally the Indian Telegraph Act, 1885, and its companion statutes, with a modern code governing India's telecommunications sector. Among its most consequential provisions are those that authorise the State to intercept communications, to suspend telecommunication services, and to take temporary possession of telecom networks on broadly worded grounds of sovereignty, security, public order, and public emergency. This paper examines those powers against the constitutional baseline established by three landmark decisions: People's Union for Civil Liberties v. Union of India (1997), which laid down procedural safeguards for telephone interception; Justice K.S. Puttaswamy v. Union of India (2017), which recognised informational privacy as a fundamental right subject to a proportionality test; and Anuradha Bhasin v. Union of India (2020), which subjected internet shutdowns to the same discipline. Drawing on the Act and the Telecommunications (Procedures and Safeguards for Lawful Interception of Messages) Rules, 2024, the paper argues that, while the Act modernises the law and the Rules restate certain safeguards, the surveillance architecture continues to rest on executive self-review, lacks judicial or parliamentary oversight, and defines its grounds so broadly as to strain the necessity and proportionality requirements that the Constitution imposes. It proposes reforms, including independent authorisation, meaningful oversight, narrowed grounds, the mandatory publication and review of suspension orders, and post-facto notification to affected persons, that would reconcile legitimate security needs with the constitutional right to privacy.
